1. Contractual object
Against the payment of a deposit of CHF 50 or CHF 100, Securitas AG shall provide the Client with a key-finder badge which makes reference to the finder’s fee and has an individual number on it. A finder of lost keys is supposed to be motivated by the finder’s fee indicated on the key-finder badge to return the keys to Securitas AG as quickly as possible. After the key with the key-finder badge is returned to a branch office of Securitas AG, the immediate payout of the finder’s fee indicated on the key-finder badge shall be made by Securitas AG to the person returning the keys (Finder). Securitas AG shall endeavour to notify the Client registered with it in order to arrange the return of the keys.
2. Conclusion / Termination of the agreement
The contractual relationship shall be considered concluded when the deposit is paid by the Client and Securitas AG provides the key-finder badge. The agreement shall end when any finder’s fee is paid and the registered Client is contacted. If it is not possible to contact the Client, e.g. because his address data have not been submitted/updated, the agreement shall likewise be considered to be ended. In this case, Securitas AG shall surrender the Client’s keys to a public lost & found office after 12 months’ time. The agreement may also be ended by the Client by returning the key-finder badge to Securitas AG. In this case, the deposit shall be returned to the Client. In the event that the agreement is extended or renewed, the Client must once again pay in a finder’s fee to Securitas AG as a deposit.
3. Notification obligations of the Client
The Client must promptly give notification in writing to Securitas AG of the loss or theft of a key or a key-finder badge or changes in the Client’s address data.
4. Reservation of ownership
Securitas AG reserves ownership to the key-finder badge that it provides.
5. Deposit
The amount of the deposit shall be either CHF 50 or CHF 100. The Client must deposit this amount in advance with Securitas AG which shall serve as a finder’s fee. After a one-time payment has been made, no recurring costs shall be incurred until the end of the agreement.
6. Warranty / Liability
The anonymity of the Client shall be guaranteed. Securitas AG shall provide no guarantees whatsoever for the return of any lost keys or for the updating of the owner data. Any liability for the completeness and good condition of the keys and other objects on the key ring is expressly excluded. Otherwise, Securitas AG shall be liable for personal injury and property damage which the Client suffers from the non- contractual fulfilment of the order only up to a maximum amount of CHF 50,000 in each case. Any more extensive liability, particularly for financial losses and indirect damages, is excluded. The Client hereby expressly waives the assertion of any more extensive damage compensation claims.
7. Applicable law / Legal venue
Exclusively Swiss law shall be applicable. The legal venue shall be – subject to the proviso of any possible mandatory legal venue in accordance with the Legal Venue Act – Bern.
